TERMS AND CONDITIONS OF SALE (SWEETDROPCBD.COM)

- General Provisions
1.1. These Terms and Conditions (the “Terms”) set out the rights and obligations of MB “EBIGUS” (the “Seller”) and the buyer (the “Buyer”), as well as the procedure for purchasing goods, payment, delivery, returns, refunds, statutory warranty, complaints, and dispute resolution.
1.2. Seller details: MB “EBIGUS”, registered office: Ąžuolų g. 2, Mažieji Ibėnai, Vandžiogalos sen., Kauno r. sav. 54395Lithuania; email: info@sweetdropcbd.com; phone: +370 666 005 11.
1.3. Sales are carried out on the website sweetdropcbd.com (the “Website”).
1.4. Goods are sold and delivered only within the territory of the Republic of Lithuania, unless clearly stated otherwise on the Website.
1.5. The following persons may purchase:
a) legally capable natural persons aged 18 or older;
b) persons aged 14–18 – only with the consent of parents/guardians (except where they dispose of their own income independently or are emancipated);
c) legal entities through an authorised representative.
1.6. The Website primarily offers food supplements and cosmetic products (the “Goods”). The Goods are not intended to diagnose, treat, cure, or prevent any disease.
- Mandatory Information Before Concluding the Contract (Civil Code Art. 6.228⁷)
2.1. Before submitting an order, the Buyer is provided on the Website with essential information: the main characteristics of the Goods, the final price (including taxes), delivery price (if applicable), payment and delivery methods, expected time limits, the right of withdrawal and its exceptions, and the procedure for guarantees and complaints. 2.2. The Buyer confirms that, before purchasing, they have familiarised themselves with these Terms and other information necessary for the purchase.
- Placing an Order and Conclusion of the Contract
3.1. The Buyer may purchase with or without an account (if permitted on the Website).
3.2. The Buyer forms the shopping cart, chooses the delivery and payment method, provides the required data, and submits the order.
3.3. The contract is deemed concluded when the Buyer submits the order and receives the Seller’s automatic email confirmation of receipt of the order, and the payment (where prepayment applies) is confirmed by the payment service provider.
3.4. The Seller has the right not to fulfil an order if the Buyer provides inaccurate data, there are reasonable signs of fraud, or the Goods are out of stock; in such case the Buyer will be informed and, if payment has been made, it will be refunded.
- Prices and Payment
4.1. Prices are indicated in EUR and include applicable taxes (including VAT, where applicable). Delivery cost is provided before order confirmation.
4.2. Payments are processed via Stripe and/or Montonio (cards, bank payments, or other methods offered by the selected provider).
4.3. The Buyer undertakes to pay immediately. The order processing begins once payment confirmation is received.
- Delivery
5.1. Goods are delivered by the courier / parcel carrier / parcel locker service chosen by the Buyer from the options provided at checkout.
5.2. Estimated delivery time limits are shown during the order process. If delivery is delayed due to stock availability or objective reasons, the Seller informs the Buyer and offers a solution (a new deadline, replacement of the Goods, or cancellation of the order and a refund).
5.3. The risk of accidental loss/damage of the Goods passes to the consumer from the moment the Goods are handed over to them or to a person designated by them (in practice – upon delivery).
5.4. If the Buyer fails to provide an accurate address and/or does not collect the parcel, additional reshipping and/or storage costs may apply.
- Inspection of the Goods Upon Receipt
6.1. Upon receiving the parcel, the Buyer is recommended to check the packaging and the completeness of the Goods.
6.2. Important: no provision of these Terms may limit the Buyer’s statutory rights regarding defective Goods. Even if external damage was not recorded with the courier, the consumer does not lose statutory rights to bring claims regarding non-conformity of the Goods (e.g., hidden defects).
- Right to Withdraw Within 14 Days (Distance Contract) – Returns & Refunds
7.1. Cooling-off period. The consumer has the right to withdraw from the distance contract within 14 days from the day the Goods are received, without giving any reason, except for statutory exceptions. (European Union)
7.2. How to withdraw. To withdraw, the consumer submits a clear statement by email to info@sweetdropcbd.com (recommended to include the order number, name, contact details, and the Goods being returned).
7.3. Return deadline. The consumer returns the Goods no later than 14 days from submitting the notice of withdrawal. (European Union)
7.4. Return costs (no free returns). The consumer covers the cost of returning the Goods, except where the Goods are defective or incorrectly delivered. If the Seller fails to inform the consumer about return costs before purchase, different legal consequences may apply. (European Union)
7.5. Refund timing. The Seller refunds the amounts due no later than 14 days from receiving the notice of withdrawal, but may withhold the refund until the Goods are received back or until the consumer provides evidence that the Goods have been sent back (whichever occurs first). (European Union)
7.6. What is refunded (important).
a) Refund for Goods: as a rule, refunds are made for the returned Goods only (the Goods’ price).
b) Delivery charges: delivery/shipping charges are generally non-refundable; however, where the consumer withdraws within the 14-day period, the Seller refunds the standard (cheapest offered) delivery cost paid by the consumer, as required by consumer rules. If the consumer chose a more expensive delivery option (e.g., express), the Seller refunds only the standard delivery cost. (eur-lex.europa.eu)
7.7. Diminished value. The consumer is liable for any diminished value of the Goods if the Goods were handled beyond what is necessary to establish their nature, characteristics, and functioning.
7.8. Exceptions to the right of withdrawal (hygiene / health protection). The right of withdrawal does not apply in cases provided by law, including sealed goods which were unsealed after delivery and are not suitable for return due to health protection or hygiene reasons. This exception may apply, for example, to certain cosmetic products and food supplements if they were sealed and the seal has been broken. (eur-lex.europa.eu)
7.9. Return condition. Returned Goods must be adequately packed for transport. The Buyer should include the order number (or other identifier) inside the parcel.
7.10. Return address. Returns must be sent to: MB “EBIGUS”, Ąžuolų g. 2, Mažieji Ibėnai, Vandžiogalos sen., Kauno r. sav. 54395 Lithuania, unless the Seller provides another return address/instruction in writing.
- Defective Goods, Statutory Warranty, Consumer Rights
8.1. The Seller is liable to the consumer for any lack of conformity of the Goods that existed at the time of delivery and becomes apparent within 2 years from delivery (statutory warranty). (eccnet.eu)
8.2. If the Goods are defective, the consumer has the right to request repair, replacement, a price reduction, or termination of the contract, under the conditions set by mandatory law.
8.3. The Seller covers the costs of returning/delivering defective Goods (where it is reasonably established that the Goods do not meet quality requirements). (European Union)
8.4. Reporting a problem. The Buyer should contact the Seller by email info@sweetdropcbd.com and provide: order number, description of the issue, and (where applicable) photos of the product/packaging/label.
- Marketing and Notifications
9.1. Transactional messages (order confirmation, invoice, delivery information) are sent for the purpose of performing the contract.
9.2. Direct marketing by email/SMS is sent only with the Buyer’s prior consent, and a simple opt-out option is provided at any time.
9.3. Marketing consent is not a condition for purchasing Goods.
- Personal Data
10.1. Personal data is processed in accordance with the Privacy Policy. These Terms do not regulate the scope of GDPR matters – the Privacy Policy applies.
- Liability
11.1. The Seller is not liable for losses arising because the Buyer provided inaccurate data or failed to comply with these Terms.
11.2. No provision of these Terms may be interpreted in a way that restricts consumer rights provided by mandatory legislation.
- Complaints and Disputes
12.1. The Buyer submits complaints by email to info@sweetdropcbd.com, indicating the order details and the essence of the issue.
12.2. If a dispute cannot be resolved through negotiations, the consumer has the right to apply to the consumer dispute resolution authority in Lithuania (VVTAT) or to a court.
12.3. Note on ODR: the European Online Dispute Resolution (ODR) Platform was discontinued as of 20 July 2025, therefore it should not be used as an up-to-date dispute resolution tool. (Consumer Redress in the EU)
- Hygiene & Safety Notice (Sealed Goods)
For health protection and hygiene reasons, sealed food supplements and cosmetic products cannot be returned if the seal has been broken or the product has been opened after delivery. This does not affect your statutory rights in case of defective or non-conforming goods. - How to return a product (step-by-step)
14.1. Email us at info@sweetdropcbd.com with your order number and the items you want to return.
14.2. If eligible, pack the items securely (preferably in the original outer packaging). Include a note with: order number + your name.
14.3. Send the parcel to: MB “EBIGUS”, Ąžuolų g. 2, Mažieji Ibėnai, Vandžiogalos sen., Kauno r. sav. 54395 Lithuania.
14.4. Keep the shipping receipt / tracking code until the refund is completed.
14.5. Refunds are issued after we receive the returned goods (or proof of shipment), within the legal time limits.
Important:
- Return shipping costs are paid by the Buyer (unless the product was defective or incorrectly delivered).
- For hygiene reasons, opened/seal-broken supplements and cosmetics are not eligible for return.
- Final Provisions
13.1. These Terms are governed by the law of the Republic of Lithuania.
13.2. The Seller may amend the Terms; the version in force at the time the order is placed shall apply.
